Terms and Conditions

1. Agreement

By booking photography services with Rosa Vision Studios (“Photographer”), the client (“Client”) agrees to be bound by the following Terms and Conditions. These Terms constitute the entire agreement between the Photographer and the Client unless otherwise stated in writing.

2. Booking and Payment

A signed agreement and required deposit secure the date and time of services. All remaining balances must be paid in full no later than the day of the session or event unless otherwise agreed in writing. Failure to remit payment may result in cancellation of services and forfeiture of any deposits paid.

3. Cancellation and Rescheduling

All cancellations must be submitted in writing. Deposits are non-refundable. At the Photographer’s discretion, deposits may be applied toward a rescheduled session within thirty (30) days of the original date, subject to availability. Rosa Vision Studios reserves the right to reschedule services due to weather conditions, illness, equipment failure, or circumstances beyond reasonable control.

4. Coverage and Performance

Coverage begins at the scheduled start time and ends at the scheduled conclusion time. The Photographer is not responsible for compromised coverage due to lateness, restrictions imposed by venues, weather conditions, or interference by attendees or participants.

5. Image Selection and Delivery

The Photographer retains sole discretion regarding image selection, editing style, and final delivery. The Client will receive the number of images specified in the selected package. Turnaround time is estimated and not guaranteed. Additional images may be purchased at the Photographer’s current rate.

6. Location and Fees

Photography sessions take place at a location selected by the Client or a location recommended by the Photographer. Any travel expenses, permits, entrance fees, or location fees are the sole responsibility of the Client unless otherwise agreed upon in writing.

7. Copyright and Usage Rights

All photographs remain the exclusive property and copyright of Rosa Vision Studios in accordance with United States Copyright Law. The Client is granted a non-transferable, non-exclusive license for personal use only. Commercial use, resale, or publication requires a separate written licensing agreement.

8. Model Release

The Client grants Rosa Vision Studios the irrevocable right to use images for portfolio, marketing, promotional, editorial, and advertising purposes unless the Client submits a written opt-out request prior to the session.

9. Limitation of Liability

Rosa Vision Studios shall not be liable for any indirect, incidental, or consequential damages. In the event of Photographer failure, liability shall be limited to the return of fees paid. Rosa Vision Studios is not responsible for loss or damage to personal property during sessions or events.

10. Force Majeure

The Photographer shall not be held liable for failure to perform due to events beyond reasonable control, including but not limited to acts of God, natural disasters, government restrictions, or emergencies.

11. Indemnification

The Client agrees to indemnify and hold harmless Rosa Vision Studios from any claims, damages, or liability arising from the Client’s actions, location conditions, or participation during the session or event.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts. Any legal action arising under this Agreement shall be brought exclusively in a court of competent jurisdiction within the Commonwealth of Massachusetts. 

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Acceptance

By booking services, submitting payment, or signing a contract, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
